Alternatives to Court

Mediation is a quicker, easier, cheaper and more amicable way to settle disputes following a separation. It is always preferable for parents to reach an agreement about arrangements concerning children, preventing the need to go to court.

Mediation allows each party to suggest their own solutions, with a third party, known as a mediator, assisting the two parties in the negotiation process to hopefully achieve a mutually acceptable solution. When an agreement is reached a Consent Order is drafted to make any agreement legally binding. Mediation can be considerably more flexible than court proceedings, but if mediation should prove unsuccessful the case can still be taken to court.
